NOTICE OF DEFAULT AND FORECLOSURE SALE

WHEREAS, on October 7, 2011, a certain Mortgage was executed by Yoshiko Umeki Fuller, as mortgagor, in favor of Allied Home Mortgage Corp, as mortgagee, and was recorded on October 7, 2011 at MOB 439 Folio 704 Instrument No. 354033 in the Office of the Mortgage Records of the Clerk of Court, Richland Parish, Louisiana. Thereafter, a Fixed Rate Home Equity Conversion Second Mortgage in favor of Secretary of Housing and Urban Development was executed October 7, 2011 and recorded on October 7, 2011 at MOB 439 Folio 715 Instrument No. 354034 in the Office of the Mortgage Records of the Clerk of Court, Richland Parish, Louisiana; and

WHEREAS, the Mortgage was insured by the United States Secretary of Housing and Urban Development (the Secretary) pursuant to the National Housing Act, 12 U.S.C. § 1707 et seq., for the purpose of providing single family housing; and

WHEREAS, the Mortgage is now owned by the Secretary, pursuant to an assignment dated February 13, 2017 and recorded on March 3, 2017 at MOB 491 Folio 80 Instrument No. 374014, in the office of the Mortgage Records of the Clerk of Court, Richland Parish, Louisiana; and

WHEREAS, a default has been made in the covenants and conditions of the Mortgage in that the borrower, Yoshiko Umeki Fuller is deceased as of January 15, 2021 and the property is not the principal residence of at least one surviving borrower; and

WHEREAS, the entire amount delinquent as of July 5, 2023 is $146,055.19.

WHEREAS, by virtue of this default, the Secretary has declared the entire amount of the indebtedness secured by the Mortgage to be immediately due and payable;

There will be no proration of taxes, rents or other income or liabilities, except that the purchaser will pay, at or before closing, his prorata share of any real estate taxes that have been paid by the Secretary to the date of the foreclosure sale.

When making their bids, all bidders except the Secretary must submit a deposit totaling $14,065.52 [10% of the Secretary’s bid] in the form of a certified check or cashier’s check made out to the Secretary HUD. A deposit need not accompany each oral bid. If the successful bid is oral, a deposit of $14,065.52 must be presented before the bidding is closed. The deposit is nonrefundable. The remainder of the purchase price must be delivered within 30 days of the sale or at such other time as the Secretary may determine for good cause shown, time being of the essence. This amount, like the bid deposits, must be delivered in the form of a certified or cashier’s check. If the Secretary is the highest bidder, he need not pay the bid amount in cash. The successful bidder will pay all conveying fees, all real estate and other taxes that are due on or after the delivery date of the remainder of the payment and all other costs associated with the transfer of title.  At the conclusion of the sale, the deposits of the unsuccessful bidders will be returned to them.

The Secretary may grant and extension of time within which to deliver the remainder of the payment. All extensions will be for 15-day increments for a fee of $500.00, paid in advance. The extension fee shall be in the form of a certified or cashier’s check made payable to the Secretary of HUD. If the high bidder closes the sale prior to the expiration of any extension period, the unused portion of the extension fee shall be applied toward the amount due.

If the high bidder is unable to close the sale within the required period, or within any extensions of time granted by the Secretary, the high bidder may be required to forfeit the cash deposit or, at the election of the foreclosure commissioner after consultation with the HUD representative, will be liable to HUD for any costs incurred as a result of such failure. The Commissioner may, at the direction of the HUD representative, offer the property to the second highest bidder for an amount equal to the highest price offered by that bidder.

There is no right of redemption, or right of possession based upon a right of redemption, in the mortgagor or others subsequent to a foreclosure completed pursuant to the Act. Therefore, the Foreclosure Commissioner will issue a Deed to the purchaser(s) upon receipt of the entire purchase price in accordance with the terms of the sale as provided herein. HUD does not guarantee that the property will be vacant.

The scheduled foreclosure sale shall be cancelled or adjoined if it is established, by documented written application of the mortgagor to the Foreclosure Commissioner not less than 3 days before the date of sale, or otherwise, that the default or defaults upon which the foreclosure is based did not exist at the time of service of this notice of default and foreclosure sale, or all amounts due under the mortgage agreement are tendered to the Foreclosure Commissioner, in the form of a certified or cashier’s check payable to the Secretary of HUD, before public auction of the property is completed.

The amount that must be paid if the mortgage is to be reinstated prior to the scheduled sale is $146,055.19 as of December 7, 2023, plus all other amounts that would be due under the mortgage agreement if payments under the mortgage had not been accelerated, advertising costs and postage expenses incurred in giving notice, mileage by the most reasonable road distance for posting notices and for the Foreclosure Commissioner’s attendance at the sale, reasonable and customary costs incurred for title and lien records searches, the necessary out-of-pocket costs incurred by the Foreclosure Commissioner for recording documents, a commission for the Foreclosure Commissioner, and all other costs incurred in connection with the foreclosure prior to reinstatement.

Notice is hereby given that the Town of Delhi is requesting submittal of qualification statements from professional engineering and planning firms interested in performing professional engineering services at the Delhi Municipal Airport for the project period of approximately five (5) years. Projects are to be submitted to the LA DOTD Aviation Division for approval.

The project description include:

1. New Lighting System and Control Panel

2. Runway Obstruction Removal -Phase 2

3. Runway Rehabilitation

4. Fuel Farm

5. Drainage Study

6. Runway Obstruction Removal – Phase 3

7. Drainage Improvements

8. Perimeter Security Fencing/Wildlife Fence

9. Apron Reconstruction

10. Agricultural Apron

The scope of services may include topographic surveys and preliminary investigations, preparation of preliminary and final construction plans and specifications, cost estimates, grant management, construction administration, bidding services, resident inspection and other special services. These projects are to include project administrative procedures and any additional projects that are funded within time frame of the professional services contract. Project implementation is totally dependent upon DOTD funding.

Firms interested in performing these services shall furnish three (3) copies of their statement of qualifications on a Standard Form (SF330). Scoring of the selection criteria shall be on a numerical scale of 1 to 5, with 5 being the highest possible score and 1 being the lowest possible score. The score for each criterion as it relates to this contract.

Following the evaluation of the Statement of Qualifications received by the Sponsors selection committee, the top three (3) applicants shall be placed on a short list. It shall be the option of the Sponsor, if the Sponsor or selection committee feels further evaluation of the qualifies short list applicants is necessary in order to determine the top-ranked firm, to issue a Request for Proposals (RFP) to all short list applicants. The RFP issued to all short list applicants shall contain instructions on the format (such as written proposal, interview, presentation, etc.) to be used in submitting proposals and information on how the proposals will be evaluated. Following the final evaluation of qualified applicants, the Sponsor will then enter fee negotiations with the top-ranked firm for the contract, with the unsuccessful firms being notified accordingly. Should these negotiations be unsuccessful, the Sponsor shall enter negotiations with the next highest ranked firm, and so on. The Sponsor reserves the right to reject all applicants and re-advertise for the contract. The successful firm will be required to execute a standard DOTD/Division of Aviation type contract in conformance with all Town, Parish, DOTD and FAA guidelines, standards, and assurances. REQUEST FOR PROPOSALS FOR

ADMINISTRATIVE CONSULTING SERVICES

The Town of Delhi has been approved for a grant under the Louisiana Watershed Initiative (LWI) - Round 1 for the purpose of constructing the Salter Street Stormwater Retention Pond. The Town of Delhi is interested in procuring the services of an administrative consulting firm to administer and implement the project.

The procedures for the selection of this firm will be in accordance with the procurement requirements of the Louisiana CDBG Program.  All responses received will be evaluated in accordance with the selection criteria and corresponding point system that is identified in the request for proposals package.  That package also identifies the scope of services to be performed by the selected firm. The Town will award the contract to the respondent obtaining the highest score in the evaluation process.

Interested parties are invited to secure a proposal package from Delhi Town Hall at 205 Broadway Street, Delhi, LA 71232.  The response to this request must be received at the above-named address in such a manner that it is received no later than 12:00 PM on December 15, 2023. Richland Parish Police Jury

 Public Hearing – 5:45 P.M. November 6, 2023

The Vice President called the meeting to order with the invocation given by Mr. Smith.

Pledge of Allegiance

Roll call revealed the following:

Present: Ms. Carroll and Messrs.: Craig, Stubblefield, Lively, Smith, Russell, Colvin and Wiggins

Absent: Mr. Lofton

Mr. Smith made a motion to approve the agenda. This was seconded by Mr. Colvin and passed with no opposition.

The Vice President opened the floor for comments on naming a portion of Section Road – May Beals Memorial Road. There were several visitors in attendance who had comments on changing the name. Some were for the change and others were against the change. 

The Vice President then opened the floor for comments on extending Hutchinson Road. There were no comments.

A motion was made by Mr. Smith to adjourn. Mr. Colvin seconded the motion and it passed with no opposition.

Richland Parish Police Jury

 Regular Meeting – 6:00 P.M. November 6, 2023

The Vice President called the meeting to order.

Roll call revealed the following:

There were no committee reports.

Mr. Lively made a motion to amend the agenda and this was seconded by Mr. Colvin. Motion was approved. Mr. Lively asked to include a Resolution from the Town of Rayville under the Parish Managers Report and Mr. Stubblefield asked to amend item #10 on the agenda to extend Hutchinson Rd (not naming). A motion was made by Mr. Colvin, seconded by Mr. Smith to approve the amended agenda. This motion passed with no opposition.

Motion by Mr. Smith, seconded by Mr. Lively to approve the minutes of the Richland Parish Police Public Hearing and Regular Meeting of October 2, 2023 as presented to the official journal - The Richland Beacon News. Motion passed with no opposition.

At this time the president asked visitors to address the jury. Ms. Penny Douciere and Judge Will Barham were in attendance and thanked the Police Jury for the work that has been done at the courthouse.

Mrs. Roanita Jenkins discussed health insurance options with the jury for 2024. Several plans were presented to the jury. Mr. Smith made a motion to go with option one from BCBSLA and to make the Globe Life gap policy optional for employees if they choose to take it (jury will no longer pay for this) and to go with Unum dental and vision. This was seconded by Mr. Stubblefield and passed with no opposition.

The secretary-treasurer handed out information from CAFA. A motion was made by Mr. Stubblefield, seconded by Mr. Wiggins to table. Motion passed with no opposition.

Mr. Russell asked if there was a motion to rename a portion of Section Road. Mr. Smith made a motion that no action be taken on the motion. 

Mr. Stubblefield made a motion to extend Hutchinson Road. This was seconded by Mr. Craig and passed with no opposition.

A motion was made by Mr. Stubblefield, seconded by Ms. Carroll to re-appoint Sherman Gray to the 911 Board. This motion passed with no opposition.

A motion was made by Mr. Crag, seconded by Mr. Stubblefield to do away with the logging road bond requirement. This motion failed. 

Mr. Wiggins made a motion to call for a public hearing at the December meeting to close Parish Road 5560B. This was seconded by Mr. Smith and passed with no opposition.

Mr. Smith made a motion to give the office staff (Secretary Treasurer, Parish Manager, Assistant Secretary Treasurer and Parish Manager Secretary) a $3.00 per hour raise. This was seconded by Mr. Stubblefield. Mr. Craig opposed. Motion passed.

A motion was made by Mr. Craig and seconded by Mr. Stubblefield to renew the following beverage permits for FY 2024. This motion passed.

The Secretary-Treasurer handed out the Revenue and Expenditures report (budget vs actual) and the bank balances for the month of October 2023. No action taken.

The Secretary-Treasurer discussed the transfer of the ARPA funds to the Road Fund, the plan to tint the windows at the courthouse and the need for special meeting in the next couple of weeks to discuss the budget.

Mr. Lively made a motion to advertise for Materials and Supplies for FY 2024. This was seconded by Mr. Colvin and passed with no opposition. 

The Parish Manger discussed the improvements that were being made to Christian Drive.

Mr. Lively made a motion to adopt a Resolution with the Town of Rayville. This was seconded by Mr. Craig and passed with no opposition. 

RESOLUTION

WHEREAS THE RICHLAND PARISH POLICE JURY has maintained certain roads and streets in the Northside Water District for a period exceeding three (3) years and 

WHEREAS the Town of Rayville is improving its water systems which will include certain roads and streets in the Northside water District, as well as on Christian Drive and Horn Road, which are shown on the Proposed Distribution Phase III Index Map prepared by McManus Consulting Engineers INC. Dated 9/15/2020, and request to place water mains on the outside five (5) feet of said roads rights of way now, therefore:

BE IT RESOLVED that the Richland Parish Police Jury hereby agrees to grant a right of way and allow the Town of Rayville to place its water mains and appurtenances in the outside five feet of the following parish roads and rights of way:
